These Terms of Service (“Terms”) govern your use of the DevanshThakkar.com website and any services provided by Devansh Thakkar (“I”, “me”, “my”). By using this website or hiring me for services, you agree to these Terms.
Services
I provide WordPress development, WooCommerce development, website speed optimization, SEO, bug fixing, maintenance, and related web development services as described on this website and in individual project proposals.
The specific scope, deliverables, timeline, and pricing for each project are defined in a written proposal or contract agreed upon before work begins. These Terms apply in addition to any project-specific agreements.
Engagement and Proposals
All projects begin with a consultation (typically free). Following the consultation, I provide a detailed proposal outlining scope, deliverables, timeline, and pricing. Work begins only after you approve the proposal and any required initial payment is received.
For projects conducted through Upwork, the Upwork Terms of Service also apply, and Upwork’s payment and dispute resolution mechanisms govern the engagement.
Pricing and Payment
Pricing is provided on a per-project basis in the proposal. I do not charge hidden fees. Any additional work outside the agreed scope requires a separate quote and approval before it begins.
Payment methods: PayPal, Wise (TransferWise), bank transfer, or Upwork escrow depending on the engagement type.
Payment schedule: Projects are typically split into milestones. Payment for each milestone is due upon completion and approval of that milestone’s deliverables. Specific payment terms are outlined in the project proposal.
Late payments: If payment is overdue by more than 14 days, I reserve the right to pause work until payment is received. Access to deliverables may be restricted until outstanding invoices are settled.
Revisions and Scope
Each project includes a reasonable number of revisions within the agreed scope. “Revisions” means changes to the work that was agreed upon in the proposal. New features, additional pages, or functionality not included in the original scope constitute additional work and will be quoted separately.
I offer unlimited revisions within the defined scope until you are satisfied. My goal is your complete satisfaction with the final deliverable.
Intellectual Property
Your content: You retain ownership of all content you provide, including text, images, logos, and branding materials.
Deliverables: Upon full payment, you receive ownership of the custom code and design work created specifically for your project. This includes custom theme files, custom plugins, and custom CSS/JS written for your site.
Third-party components: Your project may include third-party themes, plugins, or libraries that are licensed under their own terms (such as GPL for WordPress themes and plugins). Ownership of these components remains with their respective authors.
Portfolio rights: I retain the right to display the completed project in my portfolio and use it for promotional purposes, unless a separate non-disclosure agreement is in place.
Confidentiality
I treat all client information, business data, and project details as confidential. I will not share your information with third parties except as required to complete the project (for example, communicating with your hosting provider with your permission).
For clients requiring formal confidentiality agreements, I am happy to sign an NDA before the project begins.
Warranties and Limitations
I deliver all work to a professional standard and ensure it functions as described in the project proposal. I test all deliverables across major browsers and devices before handover.
However, I cannot guarantee specific business outcomes such as search engine rankings, traffic levels, or revenue increases. SEO and marketing results depend on many factors outside my control, including competition, content quality, and market conditions.
I am not liable for issues caused by third-party plugins, themes, hosting providers, or changes made to the website by you or others after delivery. My liability for any project is limited to the total amount paid for that project.
Support After Delivery
Each project includes a post-launch support period (typically 7-14 days) during which I fix any bugs or issues related to the delivered work at no additional charge.
For ongoing support beyond this period, I offer monthly maintenance plans. Details and pricing for maintenance plans are available on request.
Termination
Either party can terminate a project with written notice. If you terminate a project midway:
You are responsible for payment of all completed milestones and any work in progress. Completed deliverables up to the point of termination will be handed over upon payment.
If I terminate a project (which I will only do for serious reasons such as non-payment or abusive behavior), I will deliver all completed work and refund any payment for undelivered milestones.

You may use this website for informational purposes and to contact me about potential projects. You agree not to:
Use the website for any unlawful purpose. Attempt to interfere with the website’s functionality. Scrape, copy, or republish content from this website without permission. Submit false information through contact forms.
Third-Party Links
This website may contain links to third-party websites such as Upwork, hosting providers, and tool providers. I am not responsible for the content, privacy practices, or terms of these external sites.
Dispute Resolution
If a dispute arises, I prefer to resolve it through direct communication. Most disagreements can be settled with an honest conversation about expectations and deliverables.
For projects conducted through Upwork, Upwork’s dispute resolution process applies. For direct projects, disputes will be governed by the laws of India, with jurisdiction in Surat, Gujarat.
Changes to These Terms
I may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Continued use of the website or services after changes constitutes acceptance.
